Medical Treatment Under the Texas Workers' Compensation Scheme

If the employer of a person injured at work carries workers' compensation insurance, generally, the injured worker cannot sue the employer for the employer's negligence. However, the person might be able to obtain medical treatment paid by the workers' compensation carrier. If an employee sustains a compensable injury, the employee is entitled to receive reasonable healthcare necessary to cure or relieve the injury's effects, promote the worker's recovery, or enhance the worker's ability to return to or obtain work. A workers' compensation carrier continues to be liable for healthcare for the employee even if the employee achieves maximum medical improvement. Healthcare can be many things including: medical, surgical, and chiropractic care; physical therapy and occupational therapy services; hospital services and supplies; and medications.

Medical Treatment When an Employer Is not a Subscriber to the Texas Workers' Compensation System

If an employer is a "non-subscriber," or has in other words not obtained workers' compensation insurance, then the employer can be sued by an employee for injuries sustained in the course and scope of the employer's business. In such a case, there is no workers' compensation carrier to provide funds for medical treatment. An employer might, if acting in good faith, still provide funds to pay for healthcare for the injured employee. However, if the employer does not do so, the injured worker must fund medical treatment in another manner.

Health insurance of the injured worker or the injured worker's spouse or parent might be one way to obtain payment. The injured employee might also have coverage under an accident policy. If no insurance is available, a person might need to present himself at the local hospital for treatment and determine how to pay the bills at a later date. If an injured worker has a good claim, and there are no funds to pay for healthcare treatment, some health care providers will treat under what is termed a "letter of protection."
