Employee Death Lawsuits by Employee's Relatives

Generally, a Texas employee cannot sue his employer for work injuries if the employer has workers' compensation insurance. However, If an employee is killed while in the course and scope of his employment, certain of the employee's family members might be able to sue the employer directly. If an employer's gross negligence causes an employee's death, then Texas workers' compensation law allows a lawsuit to be filed against an employer - even if the employer has workers' compensation coverage. Moreover, if an employer does not have workers' compensation insurance, then the employer can be sued for the death of an employee even if the employer was not grossly negligent. There might also be other companies or persons responsible for the worker's death who can be sued by surviving family members.
