The advent of the Texas Workers' compensation system years ago changed the face of how workplace injuries are handled in Texas. If an employer chooses to obtain workers' compensation coverage, for the most part, the employer is immune from suit by an employee for workplace injuries. Instead, an injured worker must be satisfied with whatever he or she is able to obtain from a workers' compensation carrier. However, if an employer chooses to be a "non-subscriber" and not participate in the workers' compensation system, then the employer can be sued by employees for injuries sustained in the course and scope of their duties. Our law firm handles these types of claims. Further, if an employer does not have workers compensation insurance, the employer waives all common-law defenses it might have had to the employee's claims in the lawsuit. If an employee dies as a result of the gross negligence of the employer, certain members of the employee's family can sue the employer (even if the employer had workers' compensation insurance coverage). The workers' compensation scheme does not at times provide full, adequate, and appropriate compensation for injured and deceased employees and their families. If a person or company (a "third-party") other than the employer is responsible for the worker's injuries, then the third party can be sued. These types of claims are called "third-party" claims.
